General Conditions of Sale

These general terms and conditions (hence far also "General Conditions") govern the offer by Glocalwines S.r.l.s. (hence far "Trentinoaltoadigewine" or "TAAWINE") of products on www.trentinoaltoadigewine.it . The General Conditions must be accepted by the User when registering on the Site, in order to be able to take use of the offers formulated therein and to proceed with the purchase of products.
Trentinoaltoadigewine reserves the right to modify at any time in whole or in part the General Conditions, notifying users through the Site with at least 30 days' notice, if the methods of use of the products and services offered have changed. Users are therefore required to consult this page periodically, so that they are always informed about the conditions applied. It is understood that the use of the Site following these changes implies the tacit acceptance of the same.


Ownership of the Site - Typology of offers

The Site is owned by Glocalwines srls, with its registered office in Revò (TN), Italy, 38028, Via Maddalene, 20 C.F. and P.IVA 02330440229, Business Register TN 216834 . With license to sell alcohol number TNM11319H issued by the Customs Office of Trento.Unless otherwise specified on the detail page of the asset, it must be understood that the products are sold directly by Trentinoaltoadigewine.
The products can be sold either through a permanent catalogue or through" flash-deal" formulas or promotions that provide for the availability of products subject to quantitative and/or time limits. The offer of products is related to the alcohol and accessories categories (wines, sparkling wines, beers, grappas, other super-spirits and spirits). Following a purchase transaction, Trentinoaltoadigewine will issue the User with an order confirmation.


Registration to the Site

The Site is aimed exclusively at Users who have reached the age of 18. The navigation and use of the services offered within the Site are made accessible by registration procedure.
Registration is free of charge. Users who register for the Site must provide some personal data and follow all steps from the procedure (from now on also "Complete Registration"). At the time of the Complete registration, the User will be required to choose a Username and a Password,which the user undertakes not to give even temporarily to third parties and to keep with due care, diligence, and secrecy under his own responsibility, consoting such credentials the only means to identify the User and to validate his access to the offers. The User is therefore informed that all acts carried out through the use of these credentials, will be attributed to him and will have binding effect against him.
You must immediately inform TAAWINE of any unauthorized or improper use of your login credentials or report any violations by third parties. If you find violations, you may, at your discretion, prevent access to them, permanently delete the information contained therein or refuse the opening of new Accounts by the same User.
At any time, you may update and/or modify or request the deletion of the information released during registration. In case of cancellation request, however, TAAWINE may temporarily maintain, in whole or in part, such information, for the only purpose of executing any purchases made and/or being able to conclude the accounting and tax procedures.
Full Registration is necessary to proceed with the purchase of the products and to access the summary information related to the activities carried out by the User on the site (also "Account").
A Partial Registration to the Site is also allowed (from now on also "Partial Registration"), through the insertion of the user's email address only. Partial Registration allows the user exclusively to receive the newsletter,and not even to proceed with the purchase of products and/or services, or in any case to carry out other operations on the Site.


Terms of supply

The subject of TAAWINE offers is the purchase of goods at the prices indicated on the Site. TAAWINE reserves the right not to follow up orders from subjects other than the "consumer" in accordance with its commercial policy. In any case, TAAWINE does not sell alcohol to persons who are not 18 years of ageor older. By sending orders, the consumer ensures that the ordering entity and, if it is different, the recipient of the goods are both over 18 years of age.
The prices are expressed in Euros and are intended to include VAT. The shipping costs of the goods can be fixed or variable, calculated on the basis of weight, number of selected items and/or address of destination of the goods. Shipping costs can also be included in the selling price of certain items or be free of charge if the total amount of the order is greater than a certain value or as a result of a specific promotion. The User is always informed of the amount of the shipping costs before concluding the purchase procedure and making the payment.
The images accompanying the information sheets of a product or an offer may not be perfectly representative of its characteristics but differ in color, size and accessory products shown in the figure. All the information supporting the purchase is to be understood as a simple generic information material, therefore not related to the real characteristics of a single offer.
The validity of offers may be subject to quantitative or time restrictions, which may no longer be available. The date of validity and/or the available quantity of the offers are reported on the Site in such a way as to allow the User to become aware of them. TAAWINE may change the duration or quantity of an offer at any time and at its own discretion, provided that it will follow up orders placed during the duration of a given offer. An offer may be published several times over time, also as a result of agreements with the Partner or supplier of the goods. In some cases it is possible that the availability of a good will end at a time after purchase: in these cases TAAWINE, if the conditions are met, will refund the User. it is also possible that for some offers of goods a specific variant will not be guaranteed and the User will be required to specify one or more preferences at the time of purchase: in such circumstances the User is aware that he may receive a different variant of the product than that chosen at the time of purchase.


Purchase procedure and payment method

Taking note of the terms of the offer, the User may conclude the purchase following the procedure on the Site.
Before the purchase is finalized, you will see a summary that shows the unit cost of the selected asset and the total, if you purchase multiple quantities of the same item or different items. The cost of any shipping, delivery or postal costs can be fixed or variable, calculated based on the weight of the goods, the number of selected items and/or the destination address indicated by the User during the purchase process. Shipping costs can also be included in the selling price of certain items or be free if the total amount of the order is greater than a certain value or as a result of specific promotion. The User is always informed of the amount of the shipping costs before concluding the purchase procedure and making the payment. Once the purchase has been completed, the User must proceed with the payment, which will be made against TAAWINE, both in the case of Direct Sale and in the case of Intermediate Sale. Unless otherwise specified on the detail page of the asset, it must still be understood that the products are sold directly by TAAWINE.
Following the successful payment, you will receive a confirmation email containing information about the purchased offer. The email will also contain a reference to these General Terms and Conditions. The confirmation will contain a summary of the delivery and billing address. The shipment of the goods takes place on the times indicated in the order confirmation. Delivery times are indicated even before concluding the purchase procedure in the cart summary or on the product page. This information is indicative and does not represent a certain date, as it is not always possible to foresee any delays due to the courier in charge of delivery to the Customer or other causes due to third parties or force majeure not attributable to TAAWINE. In case of timed offers(flash-deal),the goods may be shipped to the User after the expiry of the same. In the absence of the confirmation email, the purchase cannot be considered validly concluded. In this case, if the amount of non-purchase is wrongly charged to the User, the user will be required to promptly notify TAAWINE, sending an email to assistenza@trentinoaltoadigewine.it, in order to allow TAAWINE to verify what happened and in case of proceeding with the refund of what has been paid.
The accepted payment methods, unless otherwise specified or agreed with you, are: credit card and prepaid cards of the Visa, Mastercard, Maestro, Postepay, American Express, Discover (Diners Club International and Pulse) circuits, with PayPal accounts, Satispay and bank transfer. TAAWINE may, in some or all cases and at its own discretion, offer the alternative method of payment half a delivery (in cash at the delivery of the goods).
The sums due are charged, unless otherwise specified in the terms of the offer, at the time of confirmation of the payment. In the case of a bank transfer, at the time of confirmation of the order, the bank details (IBAN), the amount of the transfer and the order number will be indicated. The payment by bank transfer must takeplace within the time limits indicated and in any case no later than 3 days from the order confirmation, a period beyond which it may not be possible to guarantee the fulfillment of the goods: in this case TAAWINE will recredit to the sender, without additional costs and half a bank transfer, any payment received beyond the deadlines.
If the User realizes that he has provided incorrect and/or incomplete information about his details
or the shipping address of the goods, it is necessary that he communicates it promptly and within the terms of fulfillment of orders, sending an email to the address assistenza@trentinoaltoadigewine.it. In all cases, the User is solely responsible for any indication of incorrect and/or incomplete details or delivery address, with consequent possibility of loss of the amount paid if the goods are delivered to strangers.


Transaction security

TAAWINE does not process and store payment card data (e.g. credit card numbers), which are processed and/or stored by the relevant payment service providers. The actual payment takes place through fields of entry of the protected and encrypted payment data, served directly by the payment service. Only after the transaction has taken place, the service provider shall notify TAAWINE of the outcome of the payment, without providing any sensitive information. For this reason, TAAWINE has no power over the possible refusal of the credit card used for payment. TAAWINE cannot therefore be held in any way responsible for direct or indirect consequences deriving from the use of the credit card by the user to make the payment of the purchased products and/or services.
Navigation on TAAWINE is protected and encrypted with the "SSL" securitycertificate, issued by Register following a precise and constant process of verifying the authenticity of the company's personal information and the ownership of the domain. It is also possible to verify the authenticity of the certificate and its ownership by clicking in the appropriate protection section of the browser in use, generally next to the address bar, on the title of the page or on the status bar.


Voucher

TAAWINE may issue discount codes (from now on also "Vouchers") that you may use when purchasing the products. Vouchers are issued in the form of an alphanumeric code and their value (in euros) is established unquestionably and at its own discretion by TAAWINE. The Voucher can be entered by the User in the appropriate "Voucher" field at the time of placing the order. The Voucher thus entered will be automatically reduced, and before payment, from the total amount of the order excluding any shipping costs. Vouchers with percentage discount are not applied to products already in promotion. Vouchers are generally usable by the user for a limited period of time, after which they will no longer be usable. The Voucher may be subject to a minimum amount of expenditure under which the use of the same will not be possible. Unless otherwise specified, the Voucher is personal and linked to the User's Account and can be used for a single purchase, after which it will be automatically invalidated. Vouchers cannot be combined. Vouchers may not be sold, transferred and/or transferred to third parties unless with the express permission of TAAWINE. TAAWINE reserves the right to cancel any Voucher previously issued, even before the expiration date, without the obligation to justify the reason and without the right to compensation or compensation. TAAWINE may also issue Vouchers to Users who invite acquaintances, friends and family to view the offers of the Site and register on the same


Shipping and delivery

TAAWINE and its possible Partners accept orders with delivery exclusively on Italian territory, including islands, with the exception of Livigno and Campione d'Italia. The shipment of the asset takes place within the maximum time possibly indicated in the conditions of the offer and, fortimed offers (flash-deal),it may start from the end of the same. The shipment of the goods takes place on the times indicated in the order confirmation. Delivery times can be indicated even before concluding the purchase procedure in the cart summary or on the product page. This information is indicative and does not represent a certain date, as it is not always possible to foresee any delays due to the courier in charge of delivery to the Customer. In any case TAAWINE, unless otherwise specified on the product sheet, undertakes to deliver the goods within 20 working days from the date of the order and on average the things take place in 24/48 working hours throughout Italy except for the islands where the average delivery times are 48/72 working hours. In the remote event that the goods become unavailable for any reason after receipt of the order, a refund of any payment received will be issued, without charge to the User. The User will be informed, if available, of the name of the courier and the tracking code of the shipment (Car Letter or "Tracking"), through which it will be possible to follow its status. This information, if available, will also be visible within the User Account.
TAAWINE cannot guarantee that multiple products purchased at the same time are delivered with a single shipment, nor that any different shipments arrive at their destination at the same time. It is not possible to guarantee a precise date or time of delivery as this depends on the courier, the destination address and the person in charge of the delivery. TAAWINE cannot therefore be held responsible for any direct or indirect consequences arising from these timings. The delivery of what is ordered is understood, unless otherwise specified during the purchase process, on the street floor.
In the shipment of bottles, TAAWINE uses patented packaging approved by the courier, designed to guarantee the integrity of the product. In any case, at the time of delivery of the goods by the courier, the User will be required to verify that the packaging is intact, undamaged, or otherwise altered, even in the closing materials (adhesive tape or hold) or that it does not present spillage of liquid. Any damage to the packaging and/or the product must be immediately disputed by the User, by setting up a written control reserve (and specifying the reason for the reserve, e.g. "Laundry packaging", "Crushed packaging", etc.) on the courier's delivery document. Once this document has been signed, the User will no longer be able to make any dispute about the characteristics of what has been delivered. Any problems related to the physical integrity, correspondence or completeness of the products received must be reported within 3 days of delivery, writing an email to:

In case of non-delivery of the goods within the indicated time, the User will be required to notify TAAWINE, which will check with the Partner and/or directly with the courier, the status of the shipment and any anomaly. Following a shipping anomaly (e.g. lost or destroyed package during transport), TAAWINE will re-send the product, compatible with the availability of the same in stock, without additional expenses or burdens for the user, or, to refund the order in full.


Product compliance assurance

TAAWINE works diligently and in absolute good faith in selecting suppliers and Partners, verifying their actual suitability to supply the products in the quantities and according to the characteristics described in the purchase offers, it being understood that TAAWINE cannot be liable for damages to persons resulting from any violation by the manufacturers. In any case, TAAWINE cannot guarantee the completeness of either the content of the information provided by the Supplier or partner, nor the perfect correspondence of what is described in the product or offer sheet with the product actually delivered, as well as the legitimacy of the use by the Supplier or Partner of the images, videos and distinctive signs. The User is also aware that the images used on the proposals can sometimes only be indicative of the product and not always faithfully represent the product delivered.


Withdrawal

The User who requests a service for purposes unrelated to his professional activity has the right to withdraw from the purchase contract concluded with TAAWINE and without having to provide any reasons, within 14 working days pursuant to and for the effects of article 52 paragraph 1 of the Consumer Code, which start from the day of receipt of the product purchased on TAAWINE. The withdrawal may be exercised by the Customer, pursuant to art. 54 paragraph 1 Consumer Code, by email to the address info@trentinoaltoadigewine.it , the email must contain the indication of the product and the order number, his name, address and if available No. phone and email address. The burden of proof relating to the correct exercise of the right of withdrawal, in accordance with the procedure indicated above, is borne by the User.
Following the correct exercise of the withdrawal, the User will have the burden of returning the property without undue delay and in any case within 14 days from the date on which the User communicated to Taawine his decision to withdraw from the contract pursuant to art. 54, c. 4. The User must apply, on the packaging, in a visible way the document received by TAAWINE following the withdrawal notice above, in which the shipping address and the details relating to the order necessary to identify the return to the destination are already indicated. It is advisable for the User to insert a copy of this document also inside the packaging, in order to avoid loss or the impossibility of identifying the return once it has been received in stock.

The relative costs of shipping the goods will be borne by the User,except in the event that TAAWINE has not informed the same about it at the time of the conclusion of the contract, in accordance with art. 57 paragraph 1 of the Consumer Code.
As provided for in art. 57 paragraph 2 of the Consumer Code, the User is responsible for any decrease in value resulting from a manipulation of the goods other than that necessary to establish the nature, characteristics and functioning of the goods themselves. In this case TAAWINE, upon written communication to be sent to the User within 5 working days of receipt of the asset, may reduce the amount of the refund due to this decrease in value, providing the same, in the event that the refund has already been paid, the bank details for the payment of the amount due by the User due due to the decrease in the value of the asset.


Exceptions to the right of withdrawal

In any case, it is understood that, with reference to the services of the service, the right of withdrawal cannot be exercised by the User after the complete supply of the products by TAAWINE if the supply itself began with the express agreement of the User and he has agreed to lose the right of withdrawal following the full performance of the service by TAAWINE.
In any case, pursuant to art. 59 of the Consumer Code, are excluded from the possibility of withdrawal of custom-made or personalized goods or that, by their nature, cannot be sent back or are subject to rapid alteration or deterioration.


Refunds

The possible disbursement of the sums by way of refund by TAAWINE, if due, will take place pursuant to art.56 paragraph 1 Consumer Code in the shortest possible time, and in any case no later than 14 days from the date on whichthe event that gave rise to the refund occurred and in case of withdrawal, from the day on which it became aware of the relative exercise by theUser. TAAWINE will perform the refund using the same means of payment used by the User for the initial transaction, unless expressly agreed differently with you and provided that the user does not have to incur any costs as a result of the use of the different means of payment. If the User has expressly chosen a different type of delivery that provides for higher delivery costs than those related to the standard delivery offered by TAAWINE ("Additional Costs"), the latter will not be required to reimburse the related Additional Costs. It is understood that, with the exception of cases where TAAWINE has decided to withdraw the goods directly, TAAWINE may withhold the refund until it has received the goods or until you have demonstrated that you have returned the goods, whichettle you are first.


Responsibility of Trentinoaltoadigewine

TAAWINE will not be liable for damages that may result from the use of the Site such as computer viruses, omissions, service interruptions and software failures, including to the detriment of your computer equipment, which prevents or delays the provision of services if these are due to external causes, force majeure and/or third parties not dependent on the will of the owner. TAAWINE will only be liable for any defects or differences found in the Direct Sale. In any case, TAAWINE cannot under any circumstances be held responsible for delays or defects or differences dependent on events beyond its reasonable control such as, but not limited to: force majeure events; events dependent on the fact of third parties such as the interruption or malfunctioning of the services of telecommunications operators and/or power lines, or acts or omissions by carriers or shippers.


Privacy

Personal data is collected and processed in order to follow up your requests. TAAWINE guarantees its users to operate in compliance with the legislation on the processing of personal data, governed by the Privacy Code referred to in Legislative Decree no. 196/2003. The privacy policy is to be considered an integral and substantial part of these General Conditions and is accessible in the Privacy section of the Site. The data controller is Glocalwines srls. Conciliation procedure. Applicable law and competent court

These General Conditions will be governed in every aspect by Italian law.
For any dispute related to the interpretation, execution and/or termination of the contract between you and TAAWINE, the Parties acknowledge that the Court of your place of residence or domicile will have jurisdiction, if the same is to be considered a "consumer" according to the applicable laws in the matter. If, on the other hand, the User is a professional, in the case of Direct Sale the Court of Trento will be competent.

Alternative dispute resolution

We inform the Consumer residing in Europe that the European Commission has established an online platform that provides an alternative dispute resolution tool. This tool can be used by the European Consumer to resolve in a non-judicial way any dispute relating to contracts for the sale of goods and services concluded online and/or deriving from them.
Consequently, if you are a Consumer established in Europe, you may use the platform to resolve any dispute arising from the online contract concluded on this site.
